Part I — Booking and Stay

Article 1

Parties and scope of application

1.1 These General Terms and Conditions govern the hospitality contract (hereinafter “Contract”) entered into between Il Girasole di Vitangeli Marco (hereinafter “the Property” or “the Owner”) and the person making the booking (hereinafter “the Guest” or “the Client”).

1.2 These Terms apply to all bookings made via: the online booking engine (Passepartout), telephone or WhatsApp (+39 0735 72192), e-mail ([email protected]) or any other direct channel.

1.3 Bookings made through OTAs (Booking.com, Airbnb, etc.) are subject to the specific conditions of each platform, except for mandatory statutory provisions.

1.4 By making a booking, the Client declares that they have read, understood and fully accepted these Terms and Conditions.

Article 2

Subject of the contract

The Contract concerns the temporary letting for tourism purposes of accommodation (rooms or glamping units) at Il Girasole Village, Contrada San Pietro 38, 63061 Massignano (AP), Italy, classified as a Campsite under Marche Regional Law 9/2006 and subsequent amendments.

Article 3

Formation of the contract and booking confirmation

3.1 A booking is deemed confirmed upon receipt by the Property of written confirmation together with payment of the confirmation deposit referred to in Art. 4.

3.2 For online bookings, the Contract is considered concluded upon completion of the deposit payment; the Client receives an automatic confirmation e-mail.

3.3 The Property reserves the right not to accept a booking or to cancel it within 48 hours if the accommodation is unavailable. In such cases the deposit is refunded in full within 7 working days.

3.4 The confirmation deposit serves as a contractual guarantee and does not constitute consideration for services; it is therefore not subject to invoicing or the issuance of any tax document. The receipt/invoice for the entire stay is issued at check-out.

Article 4

Payment methods and deposit

4.1 Confirmation deposit: at the time of booking, payment of 30% of the total is required as a confirmation deposit (caparra confirmatoria under Italian law), by credit/debit card or bank transfer.

4.2 Balance: the remaining 70% is due on arrival, in cash, by card or debit card.

4.3 Safari Tent security deposit: Safari Tent guests pay a € 150 cash deposit at check-in; the deposit is returned at check-out unless documented damage has occurred.

4.4 If the confirmation deposit is not received within 5 working days of the stated deadline, the booking is deemed unconfirmed.

4.5 Prices include VAT (where applicable). The Municipality of Massignano does not levy a tourist tax.

Article 5

Cancellation policy — Standard Rate

All cancellations must be communicated in writing by e-mail to [email protected]. The cancellation date is the date on which the communication is received by the Property.

5.1 Cancellation with deposit refund: the deposit is refunded to the Client if the cancellation is communicated at least 21 days before arrival. A flat-rate administrative fee of € 15 will be retained to cover cancellation handling costs.

5.2 Late cancellation (fewer than 21 days before arrival): the Property retains the full deposit pursuant to art. 1385 of the Italian Civil Code (Codice Civile).

5.3 No-show: the Property retains the deposit. The accommodation remains reserved until midnight on the day of arrival; after that time, the booking is deemed cancelled.

5.4 Cancellation by the Property: full refund of the deposit within 7 working days.

5.5 Force majeure: both parties are exempt from liability in the event of unforeseeable and uncontrollable circumstances. A refund or rescheduling of the stay will be agreed upon.

Article 5-bis

Exclusion of the right of withdrawal

Pursuant to art. 59(1)(n) of Italian Legislative Decree 206/2005 (Consumer Code), the 14-day right of withdrawal for distance contracts does not apply to contracts for the provision of non-residential accommodation services with a specific date or period of performance. Only the cancellation conditions set out in Art. 5 shall apply.

Article 5-ter

Non-Refundable Rate

Bookings at the “Non-Refundable” rate are subject to the following conditions:

  • Cancellation within 24 hours of confirmation: full refund (less € 15 administrative fee).
  • Cancellation after 24 hours: no refund. The full amount paid is retained.
  • No-show: the entire booking amount will be charged.

The non-refundable rate is clearly indicated at the time of booking.

Article 5-quater

Cancellation for Early Departure

Early departure due to demonstrable force majeure (death of a relative within the second degree of kinship, certified illness) does not incur a penalty for the remaining unused nights.

In all other cases, a penalty equal to the two nights following the date of notification of early departure shall apply.

  • If the original departure was fewer than two days away, only the remaining unused nights are counted.
  • In a group, only those directly affected by the event are exempt from the penalty; other members who wish to leave must pay it.

* A medical certificate or equivalent documentation is required. If not immediately available, the penalty will be refunded upon presentation of the document within 8 days of departure.

Article 6

Check-in and Check-out

6.1 Check-in: from 4:00 PM to 8:00 PM. Arrivals outside these hours must be arranged in advance.

6.2 Check-out: by 10:00 AM. Late check-out is subject to availability and a surcharge.

6.3 On arrival, the Client must present a valid identity document or passport for themselves and all guests. Personal data will be transmitted to the Public Security authorities via Alloggiati Web (art. 109 of the Italian Consolidated Law on Public Security — T.U.L.P.S.) within 24 hours.

6.4 During check-out, the accommodation unit is inspected. If damage or missing items are found, the Property shall retain the security deposit in whole or in part.

6.5 Luggage storage: the Property offers free luggage storage for arrivals before check-in or departures after check-out.

Article 7

Guest obligations and liability

7.1 Number of persons: the arrival of more persons than the maximum permitted (including children) will result in the immediate cancellation of the booking and forfeiture of the deposit.

7.2 Quiet hours: guests are required to observe quiet hours from 2:00 PM to 4:00 PM and from 11:00 PM to 8:00 AM.

7.3 No smoking inside rooms, Safari Tents, all indoor areas and the restaurant area. In case of violation, a sanitation fee will be charged.

7.4 Pets:

  • In Safari Tents: not permitted under any circumstances.
  • In rooms: permitted only during the low season, by prior arrangement.
  • In all cases: authorisation must be requested before booking + a surcharge of € 30 for final cleaning.
  • Pets must be kept on a lead. Access to the swimming pool and green areas is not permitted. The Guest is responsible for any damage and for cleaning up after their pet.

7.5 Damage: the Guest is liable for damage caused to the accommodation, furnishings and common areas by themselves, their companions or their pets.

7.6 It is forbidden to bring unregistered persons onto the premises without prior authorisation from the Property.

Article 8

Obligations and liability of the Property

8.1 The Property undertakes to provide the accommodation in the condition described and with the services indicated.

8.2 The Property is not liable for theft of or damage to personal belongings not stored in a safe or in deposit.

8.3 The Property is not liable for disruptions caused by third parties or force majeure (power outages, network failures, etc.).

8.4 The Property reserves the right to require the removal of any Guest who repeatedly breaches the House Rules, without entitlement to a refund.

Article 9

Included and additional services

9.1 Prices include: accommodation, use of common areas and swimming pool, free Wi-Fi.

  • Rooms: daily room tidying, bed linen and towel change every 3 days.
  • Safari Tents: no cleaning service is provided; linen change every 7 days.

9.2 Dining: the restaurant is open for breakfast and dinner for guests of the property. Meals are not included in the accommodation price unless specified in particular packages.

9.3 Additional services (cot hire, extra linen/towel change, washing machine use, room selection, etc.) are available on request and at an additional charge.

Article 10

Governing law and jurisdiction

10.1 The Contract is governed by Italian law (Italian Legislative Decree 206/2005, GDPR, Marche regional legislation).

10.2 Any dispute arising from this Contract shall be subject to the exclusive jurisdiction of the Court of Fermo.

Part II — House Rules

Article 11

Access to the property and day visitors

11.1 Registration in accordance with the law is mandatory for entry. Staff are authorised to stop and check anyone who has not registered.

11.2 Guests who booked through an OTA must present the voucher confirming their booking.

11.3 Day visitors: admitted only with prior authorisation from Management. They must leave a valid identity document. Overnight stays without prior registration are not permitted.

11.4 The guest who requests access for visitors is responsible for ensuring that those visitors comply with these House Rules.

Article 12

Swimming pool rules

Management sets the opening and closing times of the swimming pool. Under exceptional circumstances (weather, maintenance, events), the pool may be closed at the sole discretion of Management.

  • Flip-flops or sandals are mandatory throughout the solarium area and at the bar.
  • A towel must be placed on chairs and sun loungers.
  • A shower is mandatory before entering the water.
  • Swimming caps are mandatory.
  • Containment swimwear or waterproof nappies are mandatory for small children.
  • Entry is not permitted for anyone with open wounds, lesions, plasters or bandages, unless a medical certificate is provided.
  • Entering the pool with oils, creams or non-water-soluble sunscreen is forbidden.
  • Throwing clothing or objects into the water is forbidden.
  • Inflatable mattresses, balls and rubber dinghies are not permitted; armbands, rubber rings and goggles are allowed.
  • Diving from the edge, running on the poolside, pushing people into the water or disturbing other guests is forbidden.
  • Swimming in clothing is forbidden (a technical shirt or white cotton t-shirt is permitted for small children).
  • Bringing and consuming food and drinks at the poolside or in the water is forbidden.
  • Poolside equipment is available free of charge on a first-come, first-served basis.
Article 13

Environment and sustainability

All guests are required to respect the gardens, flower beds and cleanliness of the property. Any damage will be charged accordingly.

  • Do not dispose of waste outside the designated bins.
  • Separate paper, plastic, glass and batteries for recycling.
  • Do not damage vegetation; do not pick flowers or fruit; do not walk on flower beds.
  • Switch off lights when not needed; close doors and windows when the air conditioning is on.
  • Turn off taps after use; do not allow soapy water to run onto the ground.
  • Do not wash cars or motorcycles on the premises.
  • Open fires are not permitted. Charcoal barbecues are allowed with the utmost care, provided the smoke does not disturb neighbouring guests.
Article 14

Liability and parking

14.1 The Property accepts no liability for damage, loss or theft of personal belongings, nor for damage caused by force majeure or guest behaviour.

14.2 In the event of damage caused intentionally or through negligence, the cost of repair or replacement will be charged.

14.3 Parking: the Property provides a car park for guests. Management accepts no liability for damage, theft or loss of vehicles or items left inside them.

Article 15

Surveillance and personal data protection

15.1 The property uses surveillance cameras in common areas, positioned to minimise coverage of private areas. Guests are informed by appropriate signage.

15.2 Data collected is processed in accordance with Regulation (EU) 2016/679 (GDPR), is accessible only to authorised personnel and is used exclusively for security purposes.

Part III — Website Terms of Use

Article 16

Intellectual property

16.1 All content on the website ilgirasolevillage.com (text, photographs, graphics, logos, software) is the exclusive property of Il Girasole di Vitangeli Marco or of third parties who have granted a licence for its use.

16.2 Any reproduction or commercial use of the content without the written consent of the Owner is prohibited.

16.3 The trademark “Il Girasole Village” and its associated logo are distinctive signs of the Owner. Unauthorised use constitutes a violation of intellectual property rights.

Article 17

Limitation of website liability

17.1 The Owner keeps the content up to date but does not guarantee that it is free from errors. The definitive conditions of the stay are those confirmed in writing at the time of booking.

17.2 The Owner is not liable for service interruptions or damage resulting from unauthorised access to the website.

17.3 The website may contain links to third-party sites (Google Maps, booking portals). The Owner is not responsible for their content or policies.

Article 18

Amendments to the Terms

18.1 The Owner reserves the right to update these Terms and Conditions to reflect legislative or organisational changes. The version in force is always the one published on the website, identified by its update date.

18.2 The Terms applicable to a booking already confirmed are those in force at the time of confirmation.
